Using Diastole

These Terms of Service (“Terms”) govern your access to and use of Diastole and the assistant “Dia” — the website (diastole.ai), the text-message experience, and related software and services (the “Service”), provided by Diastole (“we,” “us”). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1.Eligibility & access

You must be at least 18 years old and able to form a binding contract. Diastole is invite-only; we may grant, limit, suspend, or terminate access at any time, with or without notice. You're responsible for activity under your account and for keeping your credentials secure.

2.Acceptable use

Don't: reverse-engineer, scrape, resell, or build a competing product from the Service; use it unlawfully, fraudulently, or to harm others; transmit spam, malware, or others' personal data without permission; or interfere with or bypass its security or operation.

3.No PHI or sensitive data

The Service is not designed for sensitive information, and you agree not to submit it — including protected health information (PHI) under HIPAA, any patient-identifying or patient-specific clinical data, government identifiers, and financial-account information. Diastole is not a HIPAA-covered service and must not be used for patient care, charting, or any electronic health record workflow.

4.Clinical reference is general, not medical advice

Dia can provide general, educational clinician-level reference (e.g. dosing, guidelines, interactions). This is not medical advice, is not a substitute for your own professional judgment, and creates no provider-patient or professional relationship. You are the clinician: independently verify anything you rely on, and never act on Dia's output for a specific identifiable patient.

5.AI output & your responsibility

Dia is powered by AI. Output may be inaccurate, incomplete, or “hallucinated,” and may be similar across users. You must review output before relying on it, and you are solely responsible for any action you take based on it — including sending a drafted email, confirming a reservation, or making a scheduling or business decision. We are not liable for outcomes of relying on the output.

6.You control real-world actions

You are in control of any real-world action. Where Dia helps carry out an action — such as sending a drafted email or adding a calendar event — it does so at your direction, and you are responsible for reviewing and approving it first. Don't rely on Dia to act on your behalf without your confirmation.

7.Connected services

You may connect third-party services (e.g. Google Calendar and Gmail). Your use of them is governed by their own terms, and you authorize us to access your data from them to provide the Service, as described in the Privacy Policy. You can disconnect them at any time. We're not responsible for third-party services.

8.Text messages

Dia operates over text/iMessage. By linking a phone number or Apple ID handle, you consent to receive messages from Dia related to your use of the Service. Message and data rates may apply. You can stop messages by replying STOP or by disconnecting in the app.

9.Your content

You own the content you provide (“User Content”). You grant us a limited license to use it solely to operate and provide the Service to you. We do not sell your content and do not use your Google data to train generalized AI models (see the Privacy Policy).

10.A free service

The Service is currently provided free of charge. We may introduce paid features in the future; if we do, we'll provide notice and separate terms, and paid features won't apply to you unless you choose them. We may change, limit, or discontinue the Service at any time.

11.Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be accurate, uninterrupted, secure, or error-free. We cannot guarantee that unauthorized parties will never defeat our security; you use the Service at your own risk.

12.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of (or inability to use) the Service. Our total liability will not exceed the greater of the amount you paid us in the prior 12 months (which, for a free service, is $0) or US $100.

13.Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

14.Termination

You may stop using the Service and ask us to delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive (e.g. 3, 5, 9, 11–13) survive termination.

15.Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. You and we agree to first try to resolve any dispute informally by contacting us. Disputes that aren't resolved will be handled in the state or federal courts located in Massachusetts, and you consent to their jurisdiction — except either party may seek injunctive relief to protect its intellectual property or data security.

16.Changes & contact

We may update these Terms; material changes will be posted here and, where appropriate, notified to you. Continued use after changes means you accept them. Questions: legal@diastole.ai.
